Hawaii is a NO FAULT state meaning that the judge won't involve himself or herself in the emotional part of your marriage at all, let alone come to conclusions about who betrayed whom, who is responsible for the divorce, and who is the worse spouse or parent. 

This means that the party who wants a divorce does not have to show a specific misbehavior on the part of the other spouse, such as adultery, abandonment, drunkenness, addiction, abuse, etc.  Therefore, it is called a "no-fault" ground for divorce, because the spouse who wants the divorce does not have to prove any marital fault (such as an affair) on the part of the other party.

The party simply has to state that there is no chance the marriage will be patched up.  This is often called, in legal terms, "irreconcilable differences" or "irretrievable breakdown."

In Hawaii, you and your spouse (and your respective lawyers, mediators, accountants and other professionals) work out the financial details yourselves.  The judge then simply reviews and signs your agreement. The judge will be reviewing only to check that the agreement is not terribly one-sided, that the parenting plan for the children is reasonable, and that child support is adequately provided.

The Law of Agency concerns the rights and liabilities created as to one individual by the acts of another.  This encompasses several distinct areas:  the contractual rights and liabilities to third persons of parties who have dealt by or through agents;  the circumstances in which one person may be liable in tort for the wrongful acts of another in his or her employ;  and the various contract and tort duties which the parties to any agency relationship owe to each other.

The most frequent type of agency problem is whether the principal (and/or agent) is contractually liable to a third party, based on the agent's conduct?

Analysis:

Is there an agency relationship i.e., an agency by agreement, ratification or estoppel?

If so, what is the nature or source of the agent's authority?

If actual authority (express or implied), does it have to be in writing (equal dignity rule)?

If no actual authority, is there apparent or ostensible authority?

What is the scope of authority (agent's powers are strictly construed)?

Can the conduct be justified as an exercise of incidental or inherent powers?

Has the authority been terminated e.g., by expiration of term, death, etc.?  If so, has it been properly communicated?

Even if the agent had an original authority to act, has there been a subsequent ratification of his acts?  Need to consider whether the conduct is capable of ratification, and whether the ratification is effective to establish liability (i.e., "relation back" theory, partial ratification, etc.).

What is the nature of Liability on the contract?

A contract must contain mutual assent, usually manifested by an offer and acceptance, and consideration.

Investigative considerations for analysis:

Was a contract made between the parties?  (Formation problems: offer and acceptance, consideration.)

Are there any reasons why the contract should not be enforced as agreed?  (Defenses to formation:  indefiniteness, mistake, Statute of Frauds, etc.)

Who has enforceable rights and/or duties under the contract?  (Problems of third-party beneficiaries, assignment and delegation.)

Is there an absolute duty to perform?  (Problems of conditions, changed circumstances, discharge.)

Defenses to the enforcement of the contract:

Indefiniteness

Mistake

Fraud, nondisclosure, duress, undue influence

Unconscionability

Lack of a writing (required by Statute of Frauds)

Lack of contractual capacity (minors, mental incompetents)

Illegality of contract purpose or consideration

Do any third parties have enforceable rights and/or obligations under the contract?

Is there an absolute duty to perform?

Once it has been determined that a contract has been made, the question is whether the reasonable expectations induced thereby have been fulfilled;  and if not, whether performance has somehow been excused or discharged by events subsequent to the formation of the contract.
